Terms of Service

This is an agreement between you or the entity that you represent (hereinafter referred to as “You” or “Your”) and TheCloudTree Private Limited (hereinafter referred to as TheCloudTree”).

Parts of this Agreement
This Agreement consists of the following terms and conditions (hereinafter the “General Terms”) and terms and conditions, if any, specific to use of individual Services (hereinafter the “Service Specific Terms”). In the event of a conflict between the General Terms and Service Specific Terms, the Service Specific Terms shall prevail.

Acceptance of the Agreement
You must be of legal age to enter into a binding agreement in order to accept the Agreement . If you do not agree to the General Terms, do not use any of our Services. If you agree to the General Terms and do not agree to any Service Specific Terms, do not use the corresponding Service. You can accept the Agreement by checking a checkbox or clicking on a button indicating your acceptance of the Agreement or by actually using the Services.

Description of Service
TheCloudTree provides comprehensive Human Capital Management (HCM) and payroll software solutions for businesses and organizations across India and globally. Our platform offers integrated cloud-based applications for end-to-end workforce management, including organogram management, employee onboarding and exit management, time and attendance tracking, expense and advance management, payroll processing, leave management, and employee self-service capabilities ("Service" or "Services"). You may use the Services for managing your organization's human resources and payroll operations. You are responsible for obtaining access to the Internet and the equipment necessary to use the Services. All employee and organizational data processed through the Services is protected under the highest security standards, and you acknowledge that you will comply with all applicable labor laws, data protection regulations, and payroll requirements in India.

Spamming and Illegal Activities
You agree to be solely responsible for the contents of your transmissions through the Services. You agree not to use the Services for illegal purposes or for the transmission of material that is unlawful, defamatory, insulting, harassing, libelous, invasive of another's privacy (including bodily privacy), abusive, threatening, harmful, vulgar, pornographic, paedophilic, harmful to children, obscene, racially or ethnically objectionable, or is otherwise objectionable, offends religious sentiments, promotes racism, contains viruses or malicious code, or that which infringes or may infringe intellectual property or other rights of another. You agree not to use the Services for the transmission of "junk mail", "spam", "chain letters", “phishing” or unsolicited mass distribution of email. We reserve the right to terminate your access to the Services if there are reasonable grounds to believe that you have used the Services for any illegal or unauthorized activity.

HCM Service Policies and Data Handling through TheCloudTree

TheCloudTree offers integrated Human Capital Management (HCM) solutions to support payroll and human resources processes. When using HCM services through TheCloudTree, the following policies apply:

a. Data Retention and Access Post-Cancellation: Upon subscription termination or expiration, customer data will be available for access and retrieval for a period of 30 days. After this 30-day retention window, all customer data will be automatically deleted unless retention is required by applicable law. During the 30-day retention period, access to the TheCloudTree HCM platform will be limited and read-only.
b. Backup and Data Export Options: Customers may retrieve their data through the TheCloudTree HCM platform during the 30-day retention period following account termination. Data export is optional - customers are responsible for proactively retrieving their data before the retention window expires. TheCloudTree recommends that customers maintain regular backups of critical employee and payroll data to ensure business continuity.
c. Subscription Reactivation and Renewal: Subscriptions may be reactivated within the 30-day data retention period following cancellation. Once reactivated, the subscription may be renewed with TheCloudTree. Customers can manage reactivation and renewal preferences through their account settings or by contacting our support team.
d. Subscription Plan Changes and Upgrades: Customers may upgrade their HCM subscription to a higher tier at any time. If a subscription upgrade is initiated during a pending cancellation period, the upgrade will override the cancellation request, and the new higher-tier plan will take effect. Pricing for the upgraded plan will be applied according to the terms specified by TheCloudTree at the time of upgrade.
e. Enterprise Add-ons and Multi-Company Support: TheCloudTree supports enterprise configurations of HCM, including multi-company subscriptions. Organizations may add company-level add-ons to extend functionality across multiple legal entities or departments. Enterprise add-on pricing and availability are subject to negotiation with TheCloudTree's sales team and TheCloudTree enterprise terms.
f. HCM Terms and Data Protection Compliance: All use of HCM services through TheCloudTree is governed by TheCloudTree's Terms of Service and Privacy Policy. HCM is certified as GDPR-compliant and ISO 27001 certified, ensuring robust data protection standards. Customers are responsible for reading and accepting TheCloudTree's terms before using the service. Conflicts between TheCloudTree's policies and integrated HCM service policies shall be resolved in accordance with the terms negotiated in the customer's service agreement with TheCloudTree.
